General Terms and Conditions (GTC) of Pharopack

1. Scope of Application
 

These General Terms and Conditions apply to all orders placed via the online shop www.pharopack.de, provided the contracting parties are businesses within the meaning of Section 14 of the German Civil Code (BGB). Sales to consumers (§ 13 BGB) are excluded.



2. Contracting Party and Conclusion of Contract


The purchase contract is concluded with Pharopack, Owner: Asli Göbelsmann. By listing the products in our online shop, we make a binding offer to conclude a contract. The contract is concluded as soon as the customer accepts the offer by clicking the button “order with obligation to pay”. The customer will receive an order confirmation by email immediately thereafter.

 

3. Prices and Payment Terms
 

All prices are net, plus the applicable statutory VAT and any shipping costs.

Payment methods:
 

  • Advance payment (bank transfer)

  • Purchase on account (payment term: 14 days net)

  • Cash payment upon collection or delivery by our company

  • Other payment terms are only possible upon individual agreement.
     

In the event of payment default, we charge interest on arrears amounting to 9 percentage points above the applicable base interest rate, as well as a default fee of €40 in accordance with Section 288 (5) BGB. Reminder fees of €5 per reminder may also be charged.

 

4. Delivery and Shipping
 

Deliveries within Germany are made via DHL, usually within 3–5 working days. International deliveries are made worldwide; delivery times are provided upon request. Express shipping is available upon request and for urgent orders. Upon handover to the shipping provider, the risk of accidental loss or deterioration of the goods passes to the customer. Transport damage must be reported immediately to the carrier and to us upon receipt of the goods.
 

Delivery Times & Force Majeure:
Delivery dates and deadlines are non-binding unless explicitly agreed in writing as binding. In the event of delivery delays due to force majeure (e.g., natural disasters, strikes, governmental actions, pandemics, war, or other unforeseeable events), the delivery period will be extended accordingly. Claims for damages due to such delays are excluded.


 

5. Retention of Title
 

The goods remain our property until full payment has been received. An extended retention of title also applies: if the delivered goods are resold by the customer, the customer hereby assigns their claims against the buyer to us in the amount of the invoice value.

 

6. Warranty
 

The statutory warranty period of 24 months from the transfer of risk applies. The customer is obliged to inspect the goods immediately upon receipt for defects and to report any obvious defects in writing within 7 days. In the event of justified defects, we will, at our discretion, either remedy the defect or deliver a replacement.

 

7. Liability


We accept no liability for damages resulting from improper use. The documents provided in the download section (www.pharopack.de/download) are binding (e.g., user manual, ICAO guidelines, AHM).
 

We are liable without limitation only for intent or gross negligence, and for injury to life, body, or health. In the case of slight negligence, we are only liable for breaches of essential contractual obligations; in such cases, liability is limited to the foreseeable, contract-typical damage.

 

8. Product Safety and Usage Obligations


Our products, especially the Pharopack foil coffins, are airtight and waterproof special films designed for the international repatriation of deceased persons and comply with international standards (e.g., Strasbourg Agreement, ICAO guidelines). Proper use in accordance with the documents provided in the download section is mandatory. The customer undertakes to comply with all legal, regulatory, and international provisions when using and distributing the products.

 

9. Export Control


Delivery is subject to the condition that there are no obstacles due to national or international regulations, in particular export control regulations and embargoes. The customer is obligated to comply with the relevant provisions and not to export goods to countries for which an export ban applies.

 

10. Offsetting and Rights of Retention
 

The customer is only entitled to offset claims that are legally established or undisputed. A right of retention may only be asserted if it is based on the same contractual relationship.



11. Data Protection


The collection and processing of personal data is carried out exclusively in accordance with our privacy policy, which is available in the online shop.



12. Applicable Law and Place of Jurisdiction


German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from this contractual relationship is Wuppertal.



13. Written Form


Amendments or additions to these GTC as well as collateral agreements must be made in writing. This also applies to the waiver of the written form requirement.



14. Final Provisions


Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
